Terms of Service
Welcome to the Donor-Advised Fund (DAF) program of CHARITABLE FOUNDATION "FAITH-HOPE-LOVE". By establishing and participating in a Donor-Advised Fund (DAF) through our organization, you agree to comply with the following Terms of Service. Please read them carefully.
1. Definitions
Donor-Advised Fund (DAF): A separately identified account maintained by CHARITABLE FOUNDATION "FAITH-HOPE-LOVE" for the purpose of charitable giving.
Donor: An individual or entity that contributes to a DAF.
Sponsoring Organization: CHARITABLE FOUNDATION "FAITH-HOPE-LOVE," a registered 501(c)(3) nonprofit organization responsible for administering the DAF program.
Grant Recommendation: A donor’s suggestion to distribute funds to eligible charitable organizations.
2. Establishing a DAF Account
A DAF account is established upon acceptance of an irrevocable contribution by CHARITABLE FOUNDATION "FAITH-HOPE-LOVE."
All contributions become the property of the Foundation and are non-refundable.
The Foundation retains exclusive legal control over all assets in the DAF.
3. Contributions
Contributions may include cash, publicly traded securities, real estate, and other non-cash assets, subject to approval by the Foundation.
Contributions are eligible for tax deductions in accordance with IRS regulations. Donors are encouraged to consult their tax advisors for specific guidance.
4. Grant Recommendations
Donors may recommend grants to IRS-qualified 501(c)(3) charitable organizations or their international equivalents.
Grant recommendations are subject to review and approval by the Foundation to ensure compliance with legal and policy guidelines.
Grants cannot be used to fulfill personal obligations, purchase goods or services, or support political campaigns or lobbying activities.

5. Fund Investment
Contributions to the DAF may be invested in Foundation-approved investment options.
The Foundation retains the sole authority to manage investment decisions and disbursements.
Investment performance may vary, and the Foundation is not liable for any gains or losses incurred.
6. Fees and Expenses
The Foundation charges administrative fees for managing DAF accounts. A schedule of fees will be provided upon establishment of the account.
Fees may be subject to change with prior notice to the donor.
7. Succession Planning
Donors may designate successors to recommend grants or specify charitable beneficiaries to receive remaining funds upon the donor’s passing.
If no successor or beneficiary is designated, the Foundation will allocate the remaining assets to charitable purposes aligned with its mission.
8. Termination of a DAF
A DAF account may be closed by the donor by recommending grants that exhaust the account balance.
The Foundation reserves the right to terminate a DAF account in cases of inactivity or non-compliance with these Terms of Service.
9. Donor Privacy
Donor information is managed in accordance with the Foundation’s Privacy Policy.
Donors may opt for anonymous giving, and their identities will not be disclosed to grant recipients.
10. Legal Compliance
All activities of the DAF program are governed by applicable federal, state, and local laws.
The Foundation complies with IRS regulations and reporting requirements for donor-advised funds.
11. Indemnification
Donors agree to indemnify and hold harmless CHARITABLE FOUNDATION "FAITH-HOPE-LOVE" from any claims, liabilities, or losses arising from participation in the DAF program, except in cases of gross negligence or willful misconduct by the Foundation.
12. Amendments
The Foundation reserves the right to amend these Terms of Service at any time to ensure compliance with legal requirements or to enhance program operations. Notice of changes will be provided to donors.
